You warrant that you are at least 18 years old and you are legally capable of entering into binding contracts. If you are under 18 years of age, you warrant that you have obtained consent from your parent or guardian and they agree to be bound by these Terms on your behalf.

By accessing or using this Website you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access this Website.

Purchases

If you wish to purchase any product or service made available through this Website, you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that:

(i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that

(ii) the information you supply to us is true, correct and complete.

We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to:

• Errors in the description or price of the product or service.
• Error in your order or other reasons.

We reserve the right to refuse or cancel your order if fraud or an unauthorised or illegal transaction is suspected.

This website is not designed to provide qualitative advice regarding the fitness for purpose and merchantability of any products or services. We strongly advise you to exercise caution and do your own due diligence in conducting any transactions through the Service.

Availability, Errors and Inaccuracies

We are constantly updating our offerings of products and services on this Website. The products or services available on our website may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information on this website and in our advertising on other web sites.

We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

The content is provided without warranties or conditions of any kind either express or implied, including but not limited to implied warranties and conditions of merchantability, fitness for a particular purpose or non-infringement.

Returns

Please choose your item/s carefully as Gym Ready does not offer returns for incorrect and/or change of mind purchases. This includes returns where you have selected the incorrect size/colour of an item, or where you have ordered the wrong product.

Returning a Faulty Item

All goods are inspected before they are delivered to make sure that we provide our customers with products of the highest quality and standard. If you receive a product that is damaged or defective, please contact us so we can guide you through the returns process and help resolve the matter promptly. Please include as many details as possible about the order and the problem with the goods, along with photos showing the defect/fault.

If the item/s is confirmed to be damaged and/or defective, we will refund the price that you paid for your item, back to your original payment method or provide a store credit at your request.

This does not apply where the item was damaged due to abnormal use or misuse, or that the goods have, following the sale to you, become of unacceptable quality due to fair wear and tear, failure to use in accordance with manufacturers’ instructions, or failure to take reasonable care.

Delivery

Orders are dispatched within 1-5 business days. Deliveries may be delayed in some instances, including:

• Any sales, peak periods, or promotional events.
• Insufficient stock – In very rare instances there may be orders placed by customers simultaneously or there is a miscount of qty/units available in stock.

Shipping is $9 Australia-wide. With no minimum spend or thresholds. $9 delivery fee is automatically applied to your order once you checkout. Tracking will be emailed to you once your item/s have been dispatched. You may receive more than one tracking number if your order is shipped in multiple satchels.

$9 delivery fee is applicable to orders delivered in Australia.

Gym Ready does not take any responsibility if you authorise your parcel to be left at your address, or if your order is lost or subsequently goes missing after it has been deemed delivered by the courier.

Product Price Match

• Price match is only available on non-Gym Ready branded items that are available on our website.
• A price match claim can be made either before you purchase an item.
• If you have found an item cheaper on another website, the product must be in stock and identical in colour/size.
• The item that you want to price match must be the regular retail price (RRP) and not be reduced as part of any sales or promotion.
• We will send you the discount/promo code for the price difference once we have verified the price of that item.
• To enable us to match a price on an item, it must be displayed and transacted on an Australian site, in Australian dollars (AUD).
• We do not offer a price match on items sold on discounted websites, or on delivery charges.

Contests, Sweepstakes and Promotions

Any contests, sweepstakes or other promotions (collectively, “Promotions”) made available through this Website may be governed by rules that are separate from these Terms. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply.

Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Website.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Website or a third-party service.

You further acknowledge and agree that Gym Ready shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We only provide links to external websites as a convenience, and the inclusion of such a link to external websites do not imply our endorsement of those websites. You acknowledge and agree that when you access other websites on the Internet, you do so at your own risk.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
